Terms of Service
These terms govern your use of zaSend, including our transactional email API, SMTP submission service, dashboard, webhooks, and related tools.
Using zaSend
You must provide accurate account information, keep your credentials secure, and use zaSend only for lawful transactional or permission-based email. We may require account approval before enabling sending, and we may suspend or reject accounts that appear risky, abusive, fraudulent, or inconsistent with these terms.
Your Domains and Sending Rights
You may only add domains that you own or are authorized to use. You are responsible for maintaining correct DNS records, sender identities, bounce handling, unsubscribe handling where required, and any legal notices required for your email program.
Acceptable Use
You may not use zaSend to send spam, purchased lists, phishing, malware, credential harvesting, deceptive content, harassment, illegal material, unsolicited bulk email, or messages that violate applicable email, privacy, consumer protection, or anti-abuse laws. You may not attempt to bypass rate limits, open relay protections, authentication, suppression lists, or reputation controls.
Email Compliance
You are responsible for the legality of your messages and recipient lists. Depending on where you and your recipients are located, this may include consent, identification, unsubscribe, data processing, and recordkeeping obligations under laws such as CAN-SPAM, GDPR, ePrivacy rules, CASL, or similar laws.
API Keys, SMTP Keys, and Webhooks
You are responsible for all activity under your API keys and domain sending keys. Keep keys secret, rotate them if exposed, and revoke keys you no longer use. Webhook endpoints must be controlled by you, use HTTPS in production where required, and be able to safely receive signed delivery events.
Service Status and Delivery
Email delivery depends on DNS, recipient servers, sender reputation, message content, recipient behavior, and third-party infrastructure. A status such as “Accepted by Postfix” means zaSend accepted the message into its sending pipeline; it is not a guarantee that the recipient inbox accepted or displayed the message.
Beta Features and Changes
zaSend may include beta, experimental, or limited-availability features. We may change limits, pricing, sending rules, authentication methods, or service behavior as we improve the platform and protect deliverability.
Fees and Plans
Free and paid plans may include usage limits, domain limits, rate limits, and feature limits. If paid plans are enabled, you agree to pay applicable fees and taxes. We may suspend sending if payment fails, usage exceeds limits, or the account creates operational or reputation risk.
Data and Privacy
Our handling of personal information is described in the Privacy Policy. You are responsible for having the rights and notices needed to submit recipient data and email content to zaSend for processing.
Suspension and Termination
We may suspend or terminate access, pause domains, throttle sending, reject messages, or remove access if we believe use of zaSend violates these terms, harms deliverability, creates security risk, causes legal risk, or threatens the reliability of the service.
Disclaimers
zaSend is provided “as is” and “as available.” We do not guarantee uninterrupted service, error-free operation, inbox placement, or compatibility with every recipient server, client, integration, or DNS provider.
Limitation of Liability
To the fullest extent allowed by law, zaSend will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, email deliverability failures, or service interruptions.
Changes to These Terms
We may update these terms as the service changes. If changes are material, we will update the effective date and, when appropriate, provide notice in the dashboard or by email. Continued use after changes means you accept the updated terms.
